Introduction

These Terms and Conditions ("Terms") govern the use of the Icons of Porsche 2023 Website (iconsofporsche.com) (“Website”), your participation in the Icons of Porsche 2023 Event which is being held at Dubai Design District from 25 November 2023 to 26 November 2023 (“Event”) and the Icons of Porsche 2023 Referral Competition ("Competition") organized by Porsche Middle East and Africa FZE a company formed pursuant to Law No. (16) of 2005 with limited liability and is registered before the Dubai Silicon Oasis Authority under Service License No.25, Plot-29-911, P.O. Box 341356, Dubai, UAE ("Organizer"). By using the Website, attending Event and or entering the Competition, you acknowledge that you have read, understood, and agree to these Terms and Conditions.

Icons of Porsche 2023 Website

1. User Eligibility

By accessing or using the Website, you warrant and represent that you have the full authority, right, and capacity to enter and abide by all of the Terms.

1. Registration 

You are required to register for the Event to access certain features of the Website. You are responsible for maintaining the confidentiality of your personal information. You must provide accurate and complete information during the registration process. You are solely responsible for any activity that occurs under your registration and the linked user data as far as it is under your control.

1. Use of Content

 All content on the Website, including text, images, and multimedia, is protected by copyright and other intellectual property laws. You may only use the content for personal, non-commercial purposes. Any other use, including reproduction or distribution, requires written permission. 

1. Error Reporting and Feedback

You may provide the Organizer either directly at [email protected] with information and feedback concerning errors, suggestions for improvements, ideas, problems, complaints, and other matters related to the Website (“Feedback”). 

1. Link to Other Websites

The Website may contain links to third party web sites or services that are not owned or controlled by the Organizer. The Organizer has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third-party web sites or services. The Organizer does not warrant the offerings of any of these entities/individuals or their websites.

You acknowledge and agree that the Organizer shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third-party web sites or services. The Organizer strongly advises you to read the terms of service and privacy policies of any third-party web sites or services that you visit.

Icons of Porsche 2023 Event

1.  Event Admission

Admission to the Event is subject to the rules and regulations set forth in the Terms. Only individuals that have registered for the Event and are in possession of a valid ticket can attend the Event and enter the Event premises. To ensure a safe and enjoyable environment for all attendees, the Organizer reserves the right to limit the number of attendees that enter the Event premises. Failure to comply with these Terms may result in denial of entry or removal from the event premises.

1. Ticket Distribution

You can register for tickets on a first-come, first-served basis and are subject to availability. The Organizer reserves the right to limit the number of tickets distributed to any individual or group.

1.  Exhibitors and Food Stands

This Event may feature various exhibitors and food stands operated by independent vendors. The Organizer is not responsible for the products, services, or activities of these vendors. Any disputes or issues arising from interactions with exhibitors or food stand operators should be addressed directly to the respective parties.

1. Speakers, Sponsors and Exhibitors.

Views expressed by any attendee, speaker, exhibitor, or sponsor at the Event are their own. The Organizer shall have no liability for advice given, or views expressed, by any attendee, speaker, exhibitor or sponsor at the Event or in any material provided to attendees.

1. Photographs, Publicity Material, Radio and Television and Print Media. 

Unless otherwise expressly agreed in writing between you and the Organizer, the Organizer retains the exclusive right to utilize any photographs, recordings, electronic images, or promotional materials acquired by or on behalf of the Organizer during the Event for any purposes it deems appropriate. The Organizer holds the exclusive authority to incorporate visual representations, including photographs, videos, and other depictions of attendees, sponsors, exhibitors, and their exhibits, including their contents, in any visual medium for trade, advertising, sales, promotional, or any other purposes, without providing additional compensation to attendees, speakers, sponsors, or exhibitors. All rights, titles, and interests (including worldwide copyrights) pertaining to such materials will be the exclusive property of the Organizer, without any claims by attendees, speakers, exhibitors, sponsors, or any individuals with vested rights or interests derived from them.

1. Code of Conduct

All attendees are expected to conduct themselves in a respectful and courteous manner. Any disruptive behavior, harassment, or unlawful activities will not be tolerated and may result in immediate removal from the event premises.

Icons of Porsche 2023 Referral Competition

1. Competition Period

The Competition will commence on 9 October 2023 at 12:00 AM GST and conclude on 26 November 2023 at 11:59pm GST (“Competition Period”).

1. Eligibility

The Competition is open to all individuals who are eighteen (18) years of age or older, receiving a referral link does not indicate eligibility to participate in the Competition. You can only take part in the Competition in your own name. Incomplete or incomprehensible registrations will be deemed invalid. All information provided by you in connection with the Competition must be true and correct; otherwise, you can be excluded and/or disqualified from the Competition. The Organizer’s decision to exclude or disqualify a participant shall be final and not subject to any form of appeal or review or discussion.

1. How to enter the Competition
2. To enter the Competition, you must register for, and attend the, Icons of Porsche 2023 Event on the Event Website https://iconsofporsche.com/registration.
3. Once you register, you will receive an email with a unique referral link. Depending on how you register, you will be allocated to a Referral Group. All participants within one Referral Group compete against each other in the Competition. Referral Groups do not compete against one another. The Referral Groups are allocated as follows:

1. The Organizer tracks the time stamp (i.e., date and time) of your registration. The first Referral Group you were allocated to at the time of registration is final and cannot be changed anymore. By way of example, if you initially register as General Attendee, but then only later notify the Organizer of a vehicle that would make you eligible for the Exhibitor Referral Group, you will remain in your originally allocated Referral Group.
2. Emirates NBD Bank (P.J.S.C.), Baniyas Road, Deira, P.O. Box: 777, Dubai, UAE (“ENBD”) offers selected customers a unique ENBD referral link that will direct you to the Website. If you register for the Event on the Website using the ENBD referral link and subject to your eligibility (see 2), you will have a chance to win Prizes to selected ENBD customers. Subject to your eligibility (see 2) and based on your Type of Registration you are also allocated to a Referral Group (see 3.2). All Terms apply.

1. How the Competition works 
2. Share your unique referral link with your friends, family, colleagues, and fellow Porsche fans. You must attend the Event as well.
3. Each person that registers for the Event using your unique referral link and attends the Event on either the 25 November or 26 November 2023 earns you one (1) ticket. Attendance only counts once, even if the person that registered using your unique referral link attends on both days. By way of example, if ten (10) people register for the Event using your unique referral link, but only six (6) people thereof attend the Event, you will earn six (6) tickets eligible for the draw.
4. After the Event, the Organizer conducts randomized draws amongst all eligible tickets earned by each of the Referral Groups. The tickets selected in the draw will have a chance to win one of the Prizes. Prizes are specific for the respective Referral Group that you have been allocated to (see 3.2).
5. Prizes
   1. Each Referral Group has a different pool of possible Prizes allocated to them:

If you register for the Event on the Website using the ENBD referral link, you will also have a chance to win one of the following Prizes: Five (5) Porsche Yas Electrified Experience. All Terms apply.

1. The Prizes are provided in the form of vouchers (codes) via email and are connected to third-party offers which are subject to third-party terms and conditions over which the Organizer has no control neither any relation nor influence whatsoever. By using the voucher, you accept that you enter a separate contract with the respective third-party and not the Organizer. Terms and Conditions - Porsche Drive Rental

1. Porsche Ice Experience

The Porsche Ice Experience takes place from 21 to 25 January 2024 in Finland. These dates and any change thereto are subject to the sole discretion of the Organizer and should you not be able to participate the Prize will be forfeited and an alternate winner will be picked/selected by the Organizer.

1. The following costs are covered by the Organizer:

One (1) admission to the ICE Experience; One (1) round-trip economy class flight to Finland departing from, and returning to, your country of residence as indicated during the registration; accommodation and catering for one (1) person from 21 to 25 January 2024.

1. The following costs are not covered by the Organizer:

Transportation to and from the airport in your country of residence as indicated during the registration; spending money; travel insurance; driving license; passport(s); visa application fees; optional activities; gratuities; any and all other ancillary costs.

1. It is your responsibility to provide all required documentation and information in a timely, complete, and accurate manner. If you are not able to participate because of incorrect documentation and information provided by you, or any delay caused at your end, the Prize will be forfeited, and an alternate winner will be picked/selected by the Organizer.
2. The third-party terms and conditions listed above apply.
3. Yas Electrified 

Yas Electrified is a driving experience located at the YAS Marina Circuit, Abu Dhabi, United Arab Emirates. 

1. The following costs are covered by the Organizer:

One (1) admission to Yas Electrified to be redeemed online at https://www.yasmarinacircuit.com/en/yas-electrified and subject to availability, valid until 31 December 2024. 

1. The following costs are not covered by the Organizer:

Transportation to and from YAS Marina Circuit, Abu Dhabi, United Arab Emirates; spending money; travel insurance; driving license; passport(s); visa application fees; optional activities; gratuities; any and all other ancillary costs.

1. It is your responsibility to provide all required documentation and information in a timely, complete, and accurate manner. If you are not able to participate because of incorrect documentation and information provided by you, or any delay caused at your end, the Prize will be forfeited, and an alternate winner will be picked/selected by the Organizer.
2. The third-party terms and conditions listed above apply.
3. Porsche Drive

Porsche Drive is a Porsche short-term rental offer located in Dubai, United Arab Emirates.

1. The following costs are covered by the Organizer:

One (1) Porsche Drive voucher for a one (1) day rental of a Porsche Taycan to be redeemed online at https://porsche-drive.ae/ and subject to availability, valid until 31 March 2024. 

1. The following costs are not covered by the Organizer:

Transportation to and from Dubai, United Arab Emirates; spending money; travel insurance; driving license; passport(s); visa application fees; optional activities; gratuities; any and all other ancillary costs.

1. It is your responsibility to provide all required documentation and information in a timely, complete, and accurate manner. If you are not able to participate because of incorrect documentation and information provided by you, or any delay caused at your end, the Prize will be forfeited, and an alternate winner will be picked/selected by the Organizer.

1. Lunch @ DRVN by Porsche

Lunch @ DRVN by Porsche is only available at the DRVN by Porsche location at Bluewaters Island, Dubai, United Arab Emirates.

1. The following costs are covered by the Organizer:

One (1) DRVN by Porsche voucher in the amount of five hundred (500) United Arab Emirates dirham to be redeemed in the DRVN by Porsche DRVN by Porsche location at Bluewaters Island, Dubai, United Arab Emirates, valid until 31 December 2024. 

1. The following costs are not covered by the Organizer:

Transportation to and from DRVN by Porsche location at Bluewaters Island, Dubai, United Arab Emirates; spending money; travel insurance; driving license; passport(s); visa application fees; optional activities; gratuities; any and all other ancillary costs.

1. Winner Selection
   1. The winners of each Referral Group will be selected by separate random drawings from all eligible tickets (see 2 and 4).
   2. Winners amongst the group of attendees that have registered for the Event on the Website using the ENBD referral link will be selected by separate random drawings from all eligible tickets (see 2 and 4). All Terms apply.
   3. The drawing will take place in January 2023.
   4. The odds of winning increase with the number of eligible tickets you have earned. However, the selection is randomized and does not take into account your total number of eligible tickets.
2. Notification of Winners and Prize Acceptance 
   1. Winners will be notified via the email address provided during the Event registration process.
   2. In the event that you are not contactable and/or fail to respond within 10 days after the Prize notification has been sent, such Prize will be forfeited and an alternate winner will be picked/selected by the Organizer. The corresponding decision and selection of the Organizer shall be final and not subject to any form of appeal or review or discussion.
   3. The Organizer reserves the right to request identification for verification purposes (to the Organizer’s satisfaction in its discretion) before issuing the Prize.
   4. The actual/appraised Prize may differ at the time the Prize is awarded. The Prize shall be determined solely by the Organizer. There shall be no cash, refund or other Prize substitution for the Prize, or any unused portion of the Prize, permitted except at the Organizer’s discretion. The Prize is non-transferable.

General Terms 

1. The Organizer reserves the right to modify, suspend, or terminate the Website, Event, Competition, or the Terms at any time without notice.
2. The Organizer's decision regarding any aspect of the Website, Event, Competition, or the Terms, including the selection of winners, is final and binding and not subject to any form of appeal or review or discussion.
3. By participating in the Competition and accepting the Prize you grant the Organizer the irrevocable, royalty free, sublicensable, fully paid up right to use each of your marks, image(s), name(s), likeness, voice(s), personality(ies) and biographical information as well as any rights equivalent or similar to any of the foregoing, now or hereafter recognized in any jurisdiction for promotional purposes and corporate communications.
4. If you use, or the Organizer reasonably suspects you to make use of prohibited aids or otherwise gain advantage through manipulation, you can be excluded / disqualified from the Competition or any part thereof.
5. Tax implications may arise from the receipt or use of a Prize for which you are responsible. Independent financial / tax advice should be sought.
6. The Organizer shall not be liable for any failure or delay in performance of the Website, Event and or the Competition and under these Terms or liable for damages if such delay or default is caused by conditions beyond its control including, but not limited to Acts of God, government restrictions, wars, insurrections and/or any other cause beyond the reasonable control of the party whose performance is affected (a "Force Majeure Event").
7. Nothing in these Terms shall exclude or in any way limit the Organizer’s liability or any liability for (i) fraud, (ii) fraudulent misrepresentation, (iii) death or personal injury caused by its negligence, or (iv) any liability to the extent the same may not be excluded or limited as a matter of law. By attending the Event, entering the Competition as well as using the Website you will on demand, indemnify, and keep indemnified, the Organizer from and against any liability, fines, penalties, claims costs (including without limitation legal and professional adviser costs), expenses, losses and damages suffered or incurred by them as a result of any tort (including negligence), breach of statutory duty, fraud, fraudulent misrepresentation, willful damage to property or person or any other willful or unlawful misconduct, in each case, attributable to or caused by you. The Organizer is not liable to you under or in connection with these Terms or the use of the Website, attendance at the Event and participation in the Competition, or any collateral contract, for any loss of income; loss of actual or anticipated profits; loss of business; loss of contracts; loss of goodwill or reputation; loss of anticipated savings; loss of, damage to or corruption of data, or for any indirect or consequential loss or damage of any kind, in each case howsoever arising, whether such loss or damage was foreseeable or in the contemplation of the parties and whether arising in or caused by breach of contract, tort (including negligence), breach of statutory duty or otherwise.
8. These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Dubai International Financial Centre, Dubai, United Arab Emirates.
9. By using the Website, attending Event and or entering the Competition, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
